1) Eligibility (Age 17+)
The Service is intended for users who are at least 17 years old. By using the Service, you represent that you are 17 or older and that you have the legal capacity to accept these Terms.
2) The Service
Heny is your intelligent photography companion that transforms your photos into insightful analysis and creative feedback. Simply upload a picture, and Heny can generate AI-powered evaluations of composition, lighting, and artistic balance, and offer practical improvement suggestions.
The Service may change over time. We may add, remove, or modify features, and we may suspend or discontinue the Service (in whole or in part) as permitted by law.
3) Accounts
You may need an account to use certain features. You agree to provide accurate information, including your name, username, and email address.
- Keep your credentials confidential
- You are responsible for activity under your account unless caused by our breach of security
4) Your content
4.1 Your ownership
You retain ownership of photos, text, and other content you submit ("User Content").
4.2 Permission to operate the Service
You grant Heny a limited, non-exclusive, worldwide license to host, process, transmit, and display your User Content solely to provide, maintain, and improve the Service and to fulfill your requests (such as generating AI-powered photography evaluations). This license ends when your User Content is deleted from our systems, except to the extent it has been de-identified or is required to be retained by law.
4.3 AI processing and deletion
Uploads for AI review are processed on servers controlled by Heny Team. We do not share these uploads with third parties for AI processing. After generating and returning the requested evaluation, we delete the uploaded content promptly after processing is completed.
4.4 No facial recognition / biometrics
We do not perform facial recognition, biometric identification, or create biometric templates from your photos. We do not use your photos to identify you or others.
4.5 No training / marketing use
We do not use your uploaded photos for model training or marketing. By default, your photos are stored locally on your device.
5) Acceptable use
You agree not to, and not to help others to:
- Violate any applicable law or regulation
- Infringe or violate the rights of others (including IP and privacy rights)
- Upload content you do not have the right to use
- Upload illegal, harmful, or abusive content
- Bypass, disable, or interfere with security-related features
- Reverse engineer or attempt to extract source code, except as permitted by law
- Use automated means to access the Service in a way that disrupts or degrades it
We may remove content or suspend/terminate access if we reasonably believe there is a violation of these Terms or a risk to users, the Service, or others.
6) Feedback
If you provide suggestions, ideas, or feedback, you grant us a non-exclusive, worldwide, royalty-free license to use it to improve the Service without obligation to you.
7) Intellectual property
The Service (excluding User Content) is owned by Heny Team or its licensors and is protected by applicable laws. These Terms do not grant you rights in our trademarks, branding, or proprietary materials.
8) Disclaimers
8.1 AI output disclaimer
The Service may generate AI-powered evaluations and suggestions. AI output may be inaccurate, incomplete, or inappropriate for your specific situation. You are responsible for how you use the output. The Service is for informational and creative purposes only and is not professional advice.
8.2 Service "as is"
To the maximum extent permitted by law, the Service is provided "as is" and "as available" without warranties of any kind.
9) Limitation of liability
To the maximum extent permitted by law, Heny Team will not be liable for indirect, incidental, special, consequential, or punitive damages, or loss of profits or revenues, arising from or related to your use of the Service.
Where liability cannot be excluded, our total liability will be limited to the amount you paid to Heny Team for the Service in the 12 months before the event giving rise to the claim (or, if you paid nothing, USD $0), unless applicable law requires otherwise.
10) Indemnification
To the maximum extent permitted by law, you agree to indemnify and hold harmless Heny Team from and against claims and expenses arising out of or related to your use of the Service or your violation of these Terms.
11) Termination
You may stop using the Service at any time. We may suspend or terminate access if we reasonably believe you violated these Terms, if required by law, or to protect the Service, users, or others.
Sections that by their nature should survive termination will survive, including Intellectual Property, Disclaimers, Limitation of Liability, Indemnification, and Dispute Resolution.
12) Privacy
Your use of the Service is subject to our privacy practices described in our Privacy Policy (available separately). Where allowed by law, you agree that we may handle information as described in that policy.
13) Changes to these Terms
We may update these Terms from time to time and will update the Effective Date above. Your continued use of the Service after an update means you accept the updated Terms to the extent permitted by law.
14) Governing law and dispute resolution (binding arbitration)
These Terms are governed by the laws of Heny Team's principal place of business, without regard to conflict-of-law rules.
Any dispute arising out of or relating to these Terms or the Service will be resolved by binding arbitration, except where prohibited by applicable law. Arbitration will be conducted on an individual basis; class actions and class arbitrations are not permitted to the maximum extent allowed by law.
15) Apple App Store terms (if applicable)
- Apple is not a party to these Terms and is not responsible for the Service.
- If these Terms conflict with mandatory App Store requirements, those requirements will control to the extent of the conflict.
